An Interpreter may be sworn at any period of the proceedings; there is no fixed form of Oath directed to be administered; the following may answer the purpose: "I.(A.B.)do swear (if aQuaker, do solemnly, sincerely, and truly declare and affirm) that I will to the best of my ability, faithfully and truly interpret, and translate, in all cases in which 1 shall be required so to do, touching the matter now before the Court, between our Sovereign Lady the Queen's Majesty, and the Prisoner on his trial. So help me God." Simmons. FORM. Application for Expenses incurred by the attendance of Civil Witnesses, at Courts Martial. Sir, Date I have the honor to transmit the within claims of the individuals, named in the margin, for expenses incurred by them in attending as witnesses, for the prosecution, on a Court Martial, assembled at by Order of, and duly summoned by me as President of the Court; agreeably to Clause XV. of the Mutiny Act. I have the honor to be, &c. &c. &c. To the Right Hon. (signed) The Secretary at War. President. Note.--Vide Form, on which Claims for travelling expenses for Members are to be stated, page 72, of Observations on the Practice, and the Forms of Courts Martial, &c, by a Field Officer. CHAPTER V. EVIDENCE. Evidence is that which either proves, or renders credible the very fact, or point in issue, and no evidence ought to be admitted to any other point, than that on which the Court are met to decide. Evidence may be either positive, or presumptive, or circumstantial. If positive evidence of a fact can be produced, circumstantial evidence ought not to be trusted.
