Excerpt: ... ceedings may be had as is or may be required by law for the settlement of the insolvent estate of a deceased person. This section, (2278) is remedial, that is, it points out the mode or manner in which the estate of the ward when insolvent, may be settled. But neither by its express provisions, nor by any necessary implication, does it create or confer any rights upon the family of the ward, and it does not confer the same right upon the wife and children of an insane ward, as is given to the wife and children of a deceased person, by section 2,375 of the Code. Custody of: prior right to.--The priority of claim to the custody of any insane person, habitual drunkard, or spendthrift aforesaid, shall be: 1. The legally appointed guardian; 2. The husband or wife; 3. The parents; i. The children. CHAPTER XXXIII. RULES IN PROBATE. Pursuant to the provisions of section 11, of chapter 134, acts of the Twenty First General Assembly, the District Judges of the State, in convention assembled, in the Supreme Court room at the Capital of the State, January 5, 1887, did prescribe uniform rules of practice for the government of the State, to take effect and be in force from and after July 4,1887. The rules thus prescribed relating to practice in probate are as follows: 1. Calendar.--The Clerk shall enter upon the Court Calendar and Bar Docket only such cases in Probate as require the action of the Court. 2. Reports Due And Not Filed.--On the first day of each term, the Clerk shall report to the presiding Judge all estates wherein an inventory or report is due under the statutes or order of Court, and which has not been filed. 3.
