J'ai fait valoir en un autre endroit la nécessité qui se présente, pour l'ensemble du système du droit, de séparer des doctrines spéciales, une partie générale qui doit leur servir de base commune (a). Une nécessité analogue se représente en particulier dans chacune des grandes théories du système ainsi, dans le droit des obligations, le droit des choses, le droitde la famille, le droit des successions. Mais il y a une raison spéciale pour donner plus d'importance à cette partie générale dans le droit des obligations et elle y revendique une place plus considérable que dans les autres grandes théories dont nous venons de parler.
