Dans la terminologie scientifique, nécessaire se dit d'une chose qui ne peut pas ne pas être (1) et nous traiterons d'actes qui ont pour cause l'exercice de la volonté humaine. Quant au mot délit, il devrait choquer en tête de ce travail, puisque la plus importante des questions que nous aurons à nous poser est celle de savoir si certains actes nécessaires sont vraiment des délits.
Il y aurait cependant difficulté et danger à ne pas user de ces termes imparfaits, car ils ont acquis, dans la langue juridique, un sens technique précis. Aucun juriste n'ignore plus aujourd'hui leur signification.
