Se)ct10n 44 On the application of the friends or relatives Of any insane person now, or who may hereafter be confined in said hospital, to the court of common pleas of Dauphin county, or to the president judge of said court in vaca tion, it shall be lawful for said court or judge, where the same may be done with safety to the community, to deliver over to such friends or relatives the person so confined; but before so delivering over such lunatic, said court or judge may require sufficient security to be given'in the name of the Commonwealth, that such lunatic shall do no injury to the person or property Of any one when at large, to continue during such term Of time' as the court or judge may direct.
