De Ribas Art. 1513, não manda, que os Embargos sé jão arti ulados, e não possão sêr oppostos senão por Petições ou Cutas embargantes isto é, offerecidas por Embargos, e dependendo sua materia de sêr articulada. Não havendo Lêí sôbre fórma externa dos Embargos, é livre ás Partes fazêl-os, como lhes-parecêr mais conveniente, articulados ou não articulados; pôsto que quasi sempre, ou sempre, sêjão articulados e com todas as formulas, e clausulas salutares, indi cadas supra nds Notas 2 5 e 297; tendo o nome de Embargante quem recorreu, e de Embaryado Parte vencedora.
