Au moment de la dissolution du mariage (ou de la séparation de biens judiciaire) il faudra dissocier ces deux patrimoines, procéder à une liquidation, rendre à chacun ce qui lui appartient.
Sous la communauté, il y a un fonds commun que les époux se partageront; a côté de cette masse, il peut v avoir des biens propres à l'un ou l'autre des conjoints; tous les biens sont présumés communs, mais avant le partage chaque époux reprendra ceux dont il est proprie taire, et, pour réussir dans sa reprise, devra combattre la présomption, démontrer la qualité de propre du bien.
