Avouer. Quelle relation y a-t - il entre le verbe avouer, con fesser, confiteri, et le substantif avoué, officier ministériel chargé de représenter les parties devant les tribunaux? L'ancienne éty melegis, qui ne consultait que les apparences superficielles, aurait dit que l'avoué était nommé ainsi parce que le plaideur lui avouait, confessait tous les faits relatifs au procès. Mais il n'en est rien; et la recherche des parties constituantes du mot ne laisse aucune place aux explications imaginaires. Avouer est formé de à et voeu; en conséquence, il signifie proprement faire voeu à quelqu'un, et c'est ainsi qu'on l'employait dans le langage de la féodal'té. Le fil qui de ce sens primitif conduit à celui de con fesser est subtil sans doute, mais très visible et très sûr. De faire voeu a quelqu'un, avouer n'a pas en de peine à signifier: approu ver une personne, approuver ce qu'elle a fait en notre nom. Enfin une nouvelle transition, légitime aussi, où l'on considère qu'a vouer une chose c'est la reconnaître pour sienne, mène au sens de confesser: on reconnaît pour sien ce que l'on confesse. Et l'avoue', que devient - il en cette filière? Ce substantif n'est point nouveau dans la langue, et jadis il désignait une haute fonction dans le régime féodal, fonction de celui à qui l'on se venait et qui devenait un défenseur. L'officier ministériel d'aujourd'hui est un diminutif de l'avoué féodal; c'est celui qui prend notre défense dans nos procès (l).
