The Northern Ireland Law Commission was established in 2007 following the recommendations of the Criminal Justice Review Group (2000). Its purpose is to keep the law of Northern Ireland under review and to make recommendations for its systematic development and reform. In the jurisdiction of Northern Ireland, there is no central governing instrument of bail legislation. There is a patchwork quilt of statutory sources, married with the exercise of the inherent jurisdiction of the High Court. The Commission believes that there is a persuasive case for the enactment of a unifying instrument of legislation regulating comprehensively the roles and responsibilities of the primary agencies concerned - the police, the Public Prosecution Service and the courts. This report sets out recommendations to achieve the following aims: (i) simplify the current law and make it more accessible; (ii) provide a legal framework that will promote consistency and transparency in bail decision making; (iii) enhance public understanding of bail decision making; (iv) ensure that the law on bail conforms with the requirements of the European Convention on Human Rights and maintains a proper balance between the right to liberty of the individual suspect and the interest of society in the prevention of crime and in the effective administration of criminal justice; (v) promote the development of appropriate administrative arrangements that will complement and ensure the effective working of any new or revised statutory scheme. The ultimate aim is to establish in statute a dedicated Bail Act in Northern Ireland.
