First of all, it may be remarked that an oral, or to use a legal phrase, a parol lease, is a very one-sided agree ment in favour of the landlord. Is proof wanted Should a man rent a building for a year which burned down within a week after taking possession without any fault of his, nevertheless he would be required to pay the rent to the end of his tenancy, nor would the landlord be required to rebuild, but might serenely keep still and com pel his tenant to pay rent, as if he were in undisturbed occupancy. In some states this common law rule has been changed by statute.1 Consequently, it behooves every one who rents a building, however short the time, to make a written lease embodying the entire agreement.
