Jacket "good" with minor scrapes and a closed tear. Not price clipped; original $14.95 price showing. "Second Edition" stated to copyright page, and Ron Arnold's "Editor's Introduction to the Second Edition" notes "many small but useful changes throughout the work," including an expanded Table of Contents, so this is a true second edition, not a mere second printing, albeit published only one year after the first. In addition to the fact the two editions bear different ISBNs, second edition appears to be most easily identified by a primarily green dust jacket, while our first edition copy has a brown dust jacket, though we're not sure that's universal. Free Enterprise Press, "a division of the Center for the Defense of Free Enterprise," clearly identified as publisher to book spine, DJ spine, title page, and copyright page. We thus find entries which list as "publisher" Merrill Press, also of Bellevue, Washington -- which is indeed listed as the distributor -- somewhat odd. The split estate and property rights in the "public lands" of the West. Hage was a rancher and historian of these topics, who fought the federal taking of his grazing rights near Tonopah, Nevada, through the courts. After his death, his daughters won those lawsuits, vindicating his arguments & analysis -- though of the course the federal government considers itself immortal, and can always find another court to hear another appeal. Covers Roots of Conflict, Genealogy of Federal Lands, Sectionalism, Forest Reserves, Private Rights, Courts, Economic Vandalism and more. A project of the Free Enterprise Legal Defense Fund. Includes bibliographical references (p. 247-258) and index. Wayne Hage (now deceased) fought the Centralized Powers of Washington D.C., who were not originally intended to have the power they now wield. He fought them along with his Sheriff's office and through the courts after they started trying to steal his water rights & his cattle, and he eventually won. Hage studied the history of land law and water rights going clear back to early colonial history and found that no land in any of the states was ever ceded or titled to the D.C. Government by the original founders, (which Mr. Hage supports in his book). The Constitutionally authorized government of that time was only given authority to sell the lands into private hands, and they were delegated and mandated by the original 13 colonies to sell all of it. Now with a usurped power in their hands (an authority that is not their's) they therefore were allowed to assume power over time as if they owned these vast tracts. As a result of this assumption of usurped power, they continue to encroach even further on the private party's property and rights as well. Signed by Author.
