Excerpt from An Analysis Criminal Liability
The principles and illustrations employed are mainly drawn from English Law; but I have not, of course, omitted anything which was to be found in the Corpus J uris, bearing upon my subject: and I am not without hope that I may subsequently enlarge this work by comparing some of the rules, of principle or practice, in bodies of modern continen tal law. Reserving, however, such a treatment of my subject for the future, I have at present purposely avoided the quota tion of many parallels, which will probably occur to my readers, from the Code Napoleon or similar sources.

Paperback. Zustand: New. Print on Demand. This book analyzes the elements of criminal liability, focusing on the culpability of criminal defendants and the ends of punishment. The culpability of the offender is the lynchpin of criminal responsibility. It requires proof that the defendantâs conduct was harmful and was also blameworthy due to either intent or negligence. The author argues that punishment should prioritize prevention of future crimes by deterring both the perpetrator and others, rather than retribution against the offender. This book is essential reading for anyone interested in the theoretical basis of criminal law.
