The case of the United States v. Kellogg Toasted Corn Flakes Co., 222 Fed. Rep. 725, was decided soon after the last mentioned decision, and it was there held that a manufacturer of a product in a patented carton, in connection with an absolute sale, could not control the price at which the package should be sub sequently resold by the jobber or retailer, without regard to the garb in which the acts were clothed.
