Excerpt from The Constitutional Provision Respecting Fugitives From Service or Labor, and the Act of Congress
The Act of Congress of September 18, 1850, relating to fugitives from service or labor, rests for its supposed author ity upon a single clause in the Constitution of the United States. In gthe language Of that clause, we, accordingly, have an absolute test for the validity of this Act. If it does not perform what the clause requires to be done; or if it does what that does not authorise; it is unconstitutional. Let us, therefore, compare the provision of the Constitution and the provision of the Act.
