The name is the mark or sign, or the sound of such mark or sign, which distinguishes or differences particular persons when it is seen or heard. The law does not nicely require to know what a man may or might with propriety be called, but, dealing only with the ordinary means of recognition, demands and is satisfied with the name of reputation: it asks, by what name is the person known Even in cases of mistake: Nil facit error nominis enm de corpore rel persona constat.

This Essay was written with the sole object of defending a very respected neighbour from a series of published attacks, of a most censurable character, directed against him on account of his having done a perfectly legal and innocent act.
The Second Part of it contains the Correspondence of Lord Llanover and others on account of Mr Herbert of Clytha having changed his Surname without a Royal License.

Paperback. Zustand: New. Print on Demand. This book delves into the fascinating history of surnames in England, examining the legal and social implications of changing one's name. The author explores the evolution of surname usage, tracing its origins from place-based designations and occupational titles to the more formalized systems that emerged over time. The book analyzes key legal cases and historical precedents, shedding light on the rights and responsibilities associated with assuming a new surname. From the 18th century, the author examines the rise of Royal Licenses as a means of formally acknowledging name changes. Through a careful analysis of historical cases, the author demonstrates that while these licenses provide a degree of formality and public recognition, they are not legally necessary to effect a valid change of name. The book concludes with a compelling argument for the legal authority of an individual's own act in publicly adopting a new name, establishing the new name as legally binding. This insightful exploration of the evolution and significance of surnames in English law offers a unique and compelling examination of a fundamental aspect of personal identity.
