Even when not one of the contracting parties, the beneficiary may bring an action against the insurer on the contract Payment by the insurer to a person not entitled to the proceeds, does not prevent the beneficiary from bringing an action against the insurer for the amount of the claim (52 N. E., but the beneficiary has no cause of action against the parties to whom the insurer paid the amount, as they have not assumed to act for him or to take the money for his use.
