This book is a legal treatise on the Partition Act of 1868, which was enacted to address the grievances arising out of enforced partnership in landed property. Prior to this act, co-ownership of land was often subject to abuse, with obstinate owners preventing the sale, lease or repair of the property, even when this would have been in the best interests of all parties. The author provides a detailed analysis of the actâs provisions, explaining how it has been used to facilitate the partitioning and sale of such properties, particularly in cases where there are multiple owners, or where some of the owners are absent or under disability. The book also discusses the impact of the act on the traditional rights of private property, and explores the delicate balance between the rights of individuals and the need for collective action in the management of land.
