Not only is the idea and the initiative of the French Code due to Napoleon, but to a very great extent its compilation. His per sonal influence was great and most beneficial.
In the elaborate discussions of its different provisions by the Commission over which he presided he evinced a profound knowl edge, an unerring judgment and a legal acumen which have excited the wonder and admiration of all jurists. Since its promulgation in 1804, the Code has remained almost unchanged excepting the abolition of divorce in 1816 and its restoration in 1884, the aboli tion of civil death in 1854, imprisonment for debt, 1867, and a few other minor changes.
Its incontestible merits have won for it the attachment of the French people of all classes and stations, and the admiration of all nations. However radically different the successive govern ments in France have been, none have ever ventured to touch the Code, which has been the law of the land under two autocratic emperors, two Bourbon kings, one constitutional monarch, and three republics.
There can be no greater testimonial to its excellence than this.
As to the proposed Civil Code of the State of New York it is needless to enter into a statement of its sources and origin. We all know how diverse and voluminous they are, and knowing, can form some conception of the vast difficulties which have been so successfully overcome in compiling it.
