Excerpt from The Commodities' Clause: A Treatise on the Development and Enactment of the Commodities' Clause and Its Construction When Applied to Interstate Railroads Engaged in the Coal Industry
Since the completion of this work more than two years ago, a number of suits have been brought by the Department of Justice against the coal-carrying roads, several decisions have been ren dered by the courts, and important investigations have been car ried on, and reports made, by the Interstate Commerce Commis sion. This new material has received careful attention in the proper connection and has necessitated a number of changes in the original. The conclusions, however, have not been changed; on the other hand they have in many cases been materially strength ened as a result of the additional data developed by the Govern ment and the Interstate Commerce Commission.

Paperback. Zustand: New. Print on Demand. This book analyzes the failure of the Commodities Clause of 1906 to prohibit the acquisition of coal mines by U.S. railroads. The author examines historic trends in European railway and coal industry relationships and compares them to the situation in the U.S. The book argues the Commodities Clause failed due to weaknesses in its language, lack of clarity in Congressional intent, and the clause being too easily circumvented by corporations. Ultimately, the author concludes that the Commodities Clause failed to prevent coal acquisition by railways due to existing loopholes that allowed for the continuation of existing practices.
