Considering that the plaintiff hath proved the material allegations of his declaration, and that the place on the highway where the accident occurred by which he lost his horse, was a dangerous place which should have been guarded by a hand rail, and which hand rail would have prevented the accident by which said horse was drowned: and that the fact of its being such a dangerous place is proved by the accident having occurred there; that said read was not fenced on either side, was narrow and not protected on the westerly side, except by alder bushes, through which plaintiff's cell, being frightened, passed into the river, and that the provisions of Art. 787 of the Munici pal Code, apply to said highway at the place of said acci dent, and that the said defendants are responsible to plaintiff for the damage sustained by him as complained of by him in his declaration, doth adjudge and condemn defendants to pay plaintiff the sum of $125, the value of said colt, with interest thereon from the 22nd of December, 1887, and costs of suit, distraits, etc.
