Where there was a charity corporation substantially, though not identically, the same in its component parts as the municipal corporation, the case was held to be within the spirit if not the letter of the section above referred to (e).

The appointment of trustees by the Court under this Legal estate, Act, though it made them custodiers of the property, could not of course transfer to them the legal estate, which notwithstanding the strong negative words used in the statute, it was decided, remained in the corpora tion (f).
