Inhaltsangabe

Lawyers rarely fail because they misunderstand the rules. They fail because nothing in their practice caught the problem in time.
A missed filing deadline, a trust account that balances on paper but not in fact, a conflict that surfaces only after the representation has begun. Disciplinary opinions record what went wrong. This book asks the earlier question: what should have been in place to stop it?
Legal Ethics Safeguards takes the ABA Model Rules of Professional Conduct as its starting point and shows how a working practice turns each duty into reliable habit. Every chapter follows the same method. It identifies the governing duty, traces the ordinary conditions under which compliance breaks down, and sets out practical safeguards proportionate to the risk. It then tests those safeguards against a realistic scenario and closes with an Attorney Self-Audit, a set of candid questions meant to be answered in writing.
The Third Edition covers the core obligations in detail: client property and trust accounts, confidentiality and privilege, conflicts of interest, truthfulness in negotiation, duties to third persons, and the special positions of prosecutors, government lawyers, and fiduciaries. It then carries the same preventive approach into ground that most ethics texts leave alone. Later chapters address professional judgment under pressure, the courage to give unwelcome advice, accountability after an error, well-being and fitness to practice, succession planning, and the culture of a firm apart from the policies it publishes.
Current developments receive direct attention, including generative artificial intelligence under ABA Formal Opinion 512, responses to negative online reviews, remote practice, and electronic payment fraud.
This book is written for:

  • solo practitioners and small-firm lawyers who have no compliance department
  • managing partners, general counsel, and ethics counsel responsible for systems that other people depend on
  • law students and new lawyers who want to understand how the rules operate in daily practice
The author holds an LL.M. from American University and was previously admitted to practice in Maryland, Virginia, the District of Columbia, and before the Supreme Court of the United States.
