India’s Criminal Justice System has evolved over centuries, from the Vedic age to the present. During ancient times head of the communities decided how the wrong doers should be punished based on the Rig Vedic Teaching guided punishments, during Sultanate era, Smriti texts and the implementation of Shariat law influenced criminal justice system, during this period. Under the Colonial Period: The East India Company played a pivotal role in shaping India’s legal landscape. These developments laid the groundwork for the enactment of codes in the 1860s (Indian Penal Code), 1872 (Indian Evidence Act), 1973 (Criminal Procedure Code). These legislations have been the back bone of Criminal Justice System, by continuously acclimatizing through amendments and judicial elucidations to meet the societal tranquillity. Admittedly, criminal justice system has undergone sweeping changes since time immemorial. It has been influenced by various doctrines and dogmas. It has experienced a sense of déjà vu at times, and a feeling of legal demarche at other times. From being a strict deterrent system through reformative regime to victim compensation and plea bargaining, criminal justice system has come a long way. While it resulted in a new wave of unforeseen crimes such as money laundering, hate crimes, terrorism, etc., it also facilitated the security forces to crack the crimes with the help of ground breaking technology like DNA test, polygraph, ethical hacking and others. Amid this scenario with the changing moral and ethical standards in the society resulted in decriminalization of some socio-legal offences and criminalized some practices that were taken for granted. India is currently undergoing this phase wherein the new-gen offences and defenses are making the revisiting of the criminal justice system sine qua non. This seminar aims to appreciate the changing facets of criminal law in India.
