Summary: In this first comprehensive work on the free trade area of the Association of Southeast Asian Nations (ASEAN) Free Trade Area (AFTA), the author argues that the ASEAN free trade area, in practice, is a failure and that unless AFTA leaders take serious measures to improve it, it will change from being "not that useful" into being completely "useless." Chapter One surveys policy aspects of regional trade agreements, including a quick review of various political and economic reasons for formation of RTAs, the relevance of these factors to ASEAN, and whether RTAs are stumbling or building blocks toward multilateral free trade. Chapter Two explores the legal aspects of RTAs and analyzes RTA-related disciplines under GATT and WTO, as well as the emerging WTO jurisprudence on RTAs. Chapter Three looks into the historical dimension of ASEAN and some of ASEAN's cooperation attempts in political and economic areas since its inception in 1967. Chapter Four explains the structural dimension of AFTA and its workings. It illustrates AFTA's trade liberalization and integration process, particularly on five important sectors: trade in goods, trade in services, investment, customs, and intellectual property. Chapter Five appraises the practical question of whether AFTA is a success or a failure. It identifies and explains ten major cracks in AFTA. Chapter Six suggests future options for AFTA.
