Some toning, scattered foxing. Light dampstaining to final leaf. Good. The official government report on the trial by court-martial of John C. Frémont, the famed explorer, army officer, and politician. In 1846, while on his third exploring expedition, Frémont rallied the American settlers in California and helped incite the Bear Flag Rebellion. As regular U.S. Army forces under Gen. Stephen Kearny and naval forces under Commodore Richard Stockton arrived in California, Frémont found himself in the middle of a quarrel between the Army and the Navy, with his own stubbornness and ego fueling the fire. Appointed territorial governor of California by Commodore Stockton, Frémont was unwilling to back down or relinquish authority to Kearny when he finally arrived on the scene. The result was a battle of wills that resulted in Frémont's court-martial. In the end, the court-martial seemed more about Gen. Kearny proving a point than anything else. Frémont was convicted but immediately had his conviction commuted and was reinstated to rank. A number of members of the court-martial board who voted for his conviction then petitioned Polk to commute his sentence. Fremont nevertheless felt the insult most keenly and resigned in disgust. Lacks final page, else good. 30th Cong., 1st Session. Senate Executive, No. 33. First edition of the detailed report of John C. Fr mont's court-martial. The charges were very serious, including mutiny. Instead of accepting President Polk's offer of clemency, Fremont's resigned his commission. The charges were mutiny, disobedience of the lawful commands of his superior officer, and conduct to the prejudice of good order and military discipline. His commanding offiver was Stephen W. Kearny. He was found to be guilty, and the sentence was dismissal. President Polk accepted the findings (except that relating to mutiny), but remitted the penalty, ordering Fr mont to retain his sword and report for duty. - Cowan. Book.
