A partir de breve reconstituição histórica, defende-se que a Constituição da República de 1988 constitui o marco normativo da consensualidade no Brasil e que o art. 26 da LINDB tem conteúdo de norma permissiva genérica de acordos administrativos, inclusive em matéria disciplinar. O exercício consensual do poder disciplinar, porém, não pode prejudicar o seu exercício imperativo, mediante a aplicação unilateral de sanções, nas hipóteses cabíveis. O que a obra propõe, em suma, é a conjugação da imperatividade (aplicação unilateral de sanção) com a consensualidade (acordos substitutivos), como instrumentos para a satisfação dos interesses públicos, sem a desconsideração dos interesses privados envolvidos no caso concreto.
