Der im italienischen Sassoferrato geborene Verfasser (um 1313-1357) war einer der bedeutendsten Rechtslehrer des Mittelalters. Er gehörte zur Richtung der Kommentatoren. Charakteristisch für sein Ansehen bei den späteren Juristen ist der Satz nemo bonus iurista nisi bartolista (niemand ist ein guter Jurist, wenn er nicht Bartoli…st [Anhänger des Bartolus] ist). Bartolus lehrte in Pisa und Perugia. Es war nicht etwas ganz Anderes, was er unternahm, in Vergleichung mit seinen Vorgängern, aber er that es besser, als die Meisten unter ihnen (Savigny, Geschichte des römischen Rechts im Mittelalter VI, 157). This adaptation of Bartolus's celebrated Tiberiad renders into the vernacular one of the most influential medieval treatments of riparian rights-addressing alluvion, avulsion, river islands, and the shifting of channels-augmented here by the annotations of Claudio Tebalducci. Long circulating in manuscript and first printed in Latin (1576), the Tiberiad stands at the intersection of Roman law doctrine and practical topography. Drawing on the jurisprudence of the Digest, Bartolus systematizes rules governing land newly formed by accretion or exposed by the recession or diversion of waters, questions central to property regimes in riverine environments. The present edition is notable for its extensive woodcut diagrams, which translate complex legal problems into spatial and geometric terms-an unusual and early instance of visual reasoning in legal literature. Bartolus (1314-1357), the preeminent commentator of the ius commune, exerted a formative influence on later civil-law doctrine; his treatment of alluvion and related phenomena remained authoritative well into the early modern period. The vernacularization offered here signals the continued practical importance of such questions for jurists, surveyors, and administrators concerned with land tenure and jurisdiction in a changing physical landscape.
