This is a notably lucid translation of the sections concerning the conflict of laws in Bartolus's Super Primam et Secundam Partem Codicis Commentaria, a commentary on the first two books of Justinian's Code and its glosses that circulated widely in manuscript and was first printed in 1471. Taken together, these sections comprise the first comprehensive statement on the subject.One of the great medieval commentators, Bartolus di Sassoferrato [1313-1357] was a professor of law at the University of Perugia. His authority as an expositor of Roman law was immense, and it endured for centuries. A practical lawyer, Bartolus attempted to derive principles suitable to his time from the accumulated layers of local, feudal and Roman law.Joseph Henry Beale [1861-1943] was a professor at Harvard Law School and served as the first dean of the University of Chicago Law School. An influential authority on the conflict of laws, corporations and criminal law, he also published important work in legal history and bibliography.
