A remarkable survival of early modern French legal culture: Jean de Basmaison Pougnetâs Paraphrase on the Coutumes of Auvergne, printed at Clermont in 1596 by Jean Durand, Libraire du Roi. Pougnet was an avocat at the Prà sidial of Riom, the judicial capital of Auvergne. His commentary digests and explains the regionâs customary law â" redacted under the crown earlier in the century â" while incorporating the great jurist Charles du Moulinâs notes. This positions the work at the intersection of local practice and French legal humanism, making it a cornerstone text for the law of Auvergne. The imprint itself is significant: Jean Durandâs press at Clermont produced relatively little compared to Parisian houses. Surviving provincial legal printings of this era are scarce, especially outside institutions. With its royal privilege and surviving armorial fiscal stamp (papier timbrà ) on the title, this copy is a tangible witness to how law was sanctioned and sold under the Ancien Rà gime. What sets this copy apart is its life in practice. The margins are thick with ink, in multiple 17thâ"18th century hands, showing how jurists and notaries actively engaged with Pougnetâs text: citing later arrêts of the royal council, debating interpretations, and applying the coutumes to matters of taille, servitudes, inheritance, and exemptions. These notes are not casual jottings but sustained commentary â" turning the book into a juristâs living archive of Auvergnat law. Inserted within are two further treasures: A manuscript memorandum (c.1740) on taille taxation and parish rolls, explicitly citing Council rulings from 1695 and later. A printed tax receipt (Ãlection de Riom, 1787) acknowledging a property declaration for the dixià me, signed by the contrà leur Couderc. Together with the annotations, these additions prove the book remained in active legal use for nearly 200 years, from its first printing in the 16th century through the fiscal debates of Louis XVIâs reign. It is extraordinarily rare to find a provincial customary law commentary surviving with such a continuous chain of use, enriched by manuscript and ephemera. This is not merely a book but a juridical archive bound in one volume â" a working tool of lawyers and magistrates that captures the evolution of French provincial law from the Wars of Religion through to the eve of the Revolution. Corners and edges with losses, gatherings exposed but holding. Title page and prelims soiled, frayed, and annotated; numerous leaves browned, stained, or edge-chipped, occasionally touching marginalia but not affecting legibility of text. Despite its battered state, this is a working provincial copy of extraordinary historical value â" its physical wear is part of the story, reflecting constant use in legal practice. Contemporary brown-stained vellum over boards, unrestored, with remains of an early handwritten paper spine label. Boards worn and scuffed, vellum with typical curling and abrasions, some worming and exposure of the text block; binding plainly provincial but authentic to its working-copy origins. Quarto.
