Paperback. Zustand: new. Paperback. This important new book is a successor to Balancing the Scales, published 20 years ago. Revisiting and extending beyond the themes in the previous collection, the authors offer new ways of thinking about the wrongs of rape and the responses of the criminal justice system. A unifying theme of t…his book, which meld critical and feminist legal analysis, is contestation. Contestation, the authors contend, is part of the DNA of rape law. Examining the principal reforms of rape law relating to consent, intimate partner rape, legal responsibility (both individual and institutional), trial and sentencing processes the authors build to their conclusion that contestation is a battle between realities, perceptions and attitudes. It is of course a forensic battle anchored to a question of (un)reasonableness, whether it relates to the actions, beliefs or decisions of the accused, the victims, the police, lawyers, judges and jurors.\nOver the past two decades, the field of rape law has been subject to much academic debate, policy development and law reform. While there has been some progress, victims experience of the law and legal process often constitutes a form of secondary trauma. To contextualise the state of the law and to assess the impact of feminist reforms, the authors devise a series of hypothetical cases to evaluate the legal reasoning of lawyers and judges at various stages of the trial and sentencing process. These accounts encourage readers to test their own and the laws normative ideals of gender justice relating to equality, privacy, fairness and human dignity. The authors conclude that fundamental concepts of rape law consent, responsibility, just punishment demand further contestation. This book provides insights and strategies for contesting laws truths in relation to rape in its many and varied manifestations. This important new book is a successor to Balancing the Scales, published 20 years ago. Revisiting and extending beyond the themes in the previous collection, the authors offer some new ways of thinking about the wrongs of rape and the responses of the criminal justice system. Paperback. Zustand: New. Illustrated. The criminal attacks that occurred in the United States on 11 September 2001 have profoundly altered and reshaped the priorities of criminal justice systems around the world. Domestic criminal law has become a vehicle for criminalising 'new' terrorist offences and other transnational forms o…f criminality. 'Preventative' detention regimes have come to the fore, balancing the scales in favour of security rather than individual liberty. These moves complement already existing shifts in criminal justice policies and ideologies brought about by adjusting to globalisation, economic neo-liberalism and the shift away from the post-war liberal welfare settlement. This collection of essays by leading scholars in the fields of criminal law and procedure, criminology, legal history, law and psychology and the sociology of law, focuses on the future directions for the criminal law in the light of current concerns with state security and regulating 'deviant' behaviour.

Soft cover. Zustand: Good. 4th Edition. "Law In Context exposes readers to the multitude of contexts (some explicit, others implicit) that affect how law is made, broken, and enforced by the state or individual citizens." Soft covers are lightly rubbed. Edges of covers and page edges are thumbed. General discolouration. Head edg…e and back cover bears some standard handling. Binding is neat and tidy. Some light scuffs and indents. Front cover creased, otherwise this book is in good condition. *We try to describe the faults of our books meticulously - they often present better than they sound.
