Marks the three great Latin-American novellas' first appearance in published form. More important, "From Cuba With A Song" also marks the very first appearance in English of the brilliant Cuban poet and novelist Severo Sarduy in English, and remains his single most celebrated work in the Spanish original and in translation. Both Fuentes and Donoso are well-known to readers in English. Their novellas, "Holy Place" and "Hell Has No Limits", are now widely regarded as Modernist classics. To this day, however - and after his untimely demise (from AIDS) - Sarduy is not. So the publisher provides helpful information about him: "Born in Cuba, Sarduy studied at the University of Havana and was one of the few writers involved in the fight against Batista. In 1960, he left for Paris, where he became the editor of the Latin-American Collection of 'Editions du Seuil'. Among the books he introduced to the French were Gabriel Garcia Marquez's 'One Hundred Years of Solitude' and Jose Lezama Lima's 'Paradiso'. Sin duda un libro recomendable. El propósito que pretende no es propiamente realizar un análisis doctrinal de fondo, sino aportar conocimiento ?desde dentro? de la institución del TEDH de Estrasburgo. El autor es un magistrado del citado Tribunal y actualmente Vicepresidente de la prestigiosa institución. Por cierto, pese a haber ejercido como abogado y jurista principalmente en Andorra, mantiene (el citado autor de este libro) una gran vinculación con España, hijo de español (Gerona) y licenciado en Derecho por la UNED y por tanto perfecto conocedor del Derecho y tradiciones de nuestro país. Junto al magistrado López Guerra ambos protagonizan la encomiable labor de la tutela de los derechos humanos por lo que se refiere al ámbito español. En concreto el autor de este libro preside la Sección Tercera, a la que dentro del TEDH le corresponden las sentencias contra España, Armenia, Letonia, Rumanía ?que es uno de los Estados con mayor número de demandas?, San Marino, Holanda, Georgia, Eslovaquia y Andorra. Se trata, por tanto, de una obra fundamental para quienes desde un punto de vista profesional quieran conocer el proceder ante este tribunal. Es destacable el conocimiento que aporta el libro, siempre apegado a las sentencias principales que ha venido dictando el Tribunal. Cada vez se plantea más la oportunidad de introducir un contencioso ante el TEDH y de ahí la necesidad de conocer bien la tramitación ante esta instancia judicial de los asuntos pertinentes. España no es un Estado que reciba tantas demandas como otros de nuestro entorno. En concreto contra España se registran unas 600 demandas al año, que son relativamente pocas comparadas con las 1. 500 que llegan contra Francia. En la primera parte la obra estudia el Convenio y sus Protocolos, el sistema de protección concebido en el año 1950 y la reforma de 1998. La segunda parte estudia el TEDH y el procedimiento que sigue la demanda desde su registro hasta la notificación de la sentencia y los principios de interpretación del Convenio. Desde luego, el presente libro recoge las distintas reformas hasta el día de hoy incluyendo la operada por el Protocolo nº 14 en vigor desde el 1 de junio de 2010. Pero la parte más destacable (siendo el quid de la obra la aportación de conocimiento que consigue) es la tercera, donde se va exponiendo la jurisprudencia del Tribunal artículo por artículo, lo que proporciona una especial utilidad a este libro. Cada vez más estas sentencias arraigan dentro de los propios procesos españoles, siendo útil el conocimiento de esta jurisprudencia no solo por la posible vía de recurso en esta instancia europea, sino también por el posible refuerzo que puede conseguirse de las propias pretensiones de parte en las instancias judiciales de corte nacional. La parte final del libro contiene unos anexos con el texto del convenio y sus protocolos y el formulario de demanda y otros documentos útiles. Un tribunal que merece atención creciente. De los catorce artículos del Convenio Europeo de Protección de Derechos Humanos, el más invocado y violado de todos es el sexto: el derecho a un juicio equitativo. Es el artículo que regula que toda persona tiene derecho a un juicio imparcial e independiente, a disponer de un abogado. Pero, en el ámbito administrativo de esta Revista donde se escribe esta recensión, puede destacarse la proyección de la jurisprudencia hacia temas tales como la defensa del derecho de propiedad o la libertad de expresión, la inactividad de la Administración, etc. Tal como ha declarado el autor recientemente, ?el TEDH es de utilidad hoy, como ya lo era antes. El respeto de los derechos fundamentales de las personas, incluso en sociedades democráticas, es un objetivo ideal, nunca definitivamente adquirido, que exige no bajar la guardia y seguir batallando?
