Large 8°, stitched; traces of early wrappers. Tear (4 cm.) in gutter, not affecting text; ink smear on p. 40 on parts of 7 lines (barely legible); light foxing. Overall in good condition. 40 pp. *** FIRST EDITION. There appears to be a second edition with only 39 pp., printed by Typ. Patriotica de Carlos José da Silva, 1836. A deputy to the Portuguese Cortes discusses who should succeed as the legitimate ruler of Portugal should D. Maria II die without issue: her first child was not born until 1837. He is particularly interested in the ramifications of D. Pedro de Alcantara's abdication and of royal heirs being born or residing outside of Portugal. On pp. 29-40, the author applies his principles to each of the possible heirs to the throne, including D. Pedro II, Emperor of Brazil. The work was written in the aftermath of the Miguelist wars, a conflict that raged for six years over whether D. Maria II or D. Miguel I was legitimate ruler of Portugal. In December 1834, the Cortes banished Miguel and all his descendants from Portugal; two years after this work appeared, the Constitution of 1838 excluded Miguel's descendants from the throne.Manuel Joaquim Cardoso Castello-Branco (Castello-Branco, 1798-1852) was extremely erudite in matters of ecclesiastical jurisprudence. He was Conego na Sé Patriarcal de Lisboa and served in the Cortes after 1834.*** Innocêncio VI, 12: calling for 39 pp., but correcting it at VI, 451 to 40 pp.; on the author, see also XVI, 231. Porbase locates five copies at the Biblioteca Nacional de Portugal, and another at the Biblioteca Nacional de Portugal with only 39 pp. Not located in Jisc. 4°, disbound. Small woodcut royal arms of Portugal on title page. Woodcut initial on p. [3]. Light stains. Overall in good to very good condition. 14 pp. *** FIRST and ONLY EDITION of two sonnets, an ode, a preface and a speech in honor of the birthday of D. João, Prince of Brazil, eldest surviving son of D. Maria I. After his brother D. José died of smallpox in September 1788, D. João became heir to the throne of Portugal. In 1789 he fell seriously ill, causing considerable anxiety; since that is not mentioned here, the illness was presumably either after his birthday (May 13) or a fair time before. His wife D. Carlota Joaquina is mentioned briefly; daughter of Carlos IV of Spain, she had been engaged to D. João as part of the negotiations for the Treaty of El Pardo, signed on March 11, 1778, when she was five and D. João was eleven. The marriage formally took place in 1785, but was not consummated until 1790, the year after this pamphlet appeared. Although the couple had nine children they were famously, passionately incompatible. The authors (father and son) were members of the Academia dos Obzequiozos, which was based in their home and had been under the protection of D. Pedro III. Innocêncio reports that João Dias Talaia Souto-Maior (d. 1795) was also an extremely skilled bullfighter (!) who published a collection of poetry (Rimas, 1790) and edited the anthology Sessões litterarias dos alumnos da Academia dos Obsequiosos, do logar de Sacavem, 1790-1791 (3 volumes). He wrote the preface to this work and published numerous short works that Innocêncio uncharacteristically failed to catalogue: "varias poesias, e outras miudezas avulsamente impressas, de que me pareceu escusado fazer aqui menção especial."*** Possibly the work briefly cited in Innocêncio XII, 72, as Poesia . a D. João VI, Lisboa"; for the elder Souto-Maior, see III, 362; VII, 257; X, 238. Porbase locates three copies, all in the Biblioteca Nacional de Portugal. Not located in Jisc.
