Kaskel zählt zu den bedeutendsten Arbeitsrechtlern der Weimarer Republik. Nachdem er seine ersten Berufsjahre dem Sozialversicherungsrecht gewidmet hatte, wendete er sich ab ca. 1919 schwerpunktmäÃig dem Arbeitsrecht zu. Als Mitglied im Arbeitsrechtsausschuss von 1919 mit dem Ziel der Schaffung eines einheitlichen Arbeitsrechts, Inhaber der ersten arbeitsrechtlichen Professur in Deutschland (ab 1920 an der Universität Berlin) und Autor seines in zahlreichen Auflagen erschienenen Hauptwerks "Das neue Arbeitsrecht" von 1920, welches ab 1924 in "Arbeitsrecht" unbenannt wurde, konnte er die Entwicklung des neuen Arbeitsrechts seiner Zeit wesentlich vorantreiben und einen Beitrag zur Etablierung des Arbeitsrechts als eigenes Rechtsgebiet leisten. Insbesondere Kaskels Ausführungen zu Begriff und Gegenstand des Arbeitsrechts, dem Arbeitnehmerbegriff, dem Arbeitsvertrag, dem Arbeitsverfassungs- und speziell dem Betriebsverfassungsrecht, geben Einblick in seine arbeitsrechtlichen Ansichten. Dabei war seine juristisch-dogmatische Arbeitsweise vor dem Hintergrund der unübersichtlichen arbeitsrechtlichen Gesetzeslage seiner Zeit von besonderem Wert für die Arbeitsrechtswissenschaft. In seiner Arbeitsrechtslehre kam er im Gegensatz zu vielen seiner Zeitgenossen ohne die Konstruktion eines Herrschaftsvertrages oder überzogener Treue- und Fürsorgekonzepte aus. Er zeichnete sich vielmehr durch moderne und freiheitssichernde Ansichten aus und betonte die Gleichordnung von Arbeitgeber und Arbeitnehmer, wobei er streng verfassungspositivistisch argumentierte und den historischen Ansatz der Berufsstände betonte. Dieses Buch zeigt auf, dass Walter Kaskel zu Unrecht weitgehend in Vergessenheit geraten ist und vielmehr zu Recht als "Schà pfer des Systems des modernen Arbeitsrechts" bezeichnet werden muss.
