This book examines the factors in the petition of the inhabitant householders of Manchester for a charter of incorporation in 1838, and the legal challenges to the authority of its consequent charter. It was argued that, to be valid, such a charter should be petitioned for by an actual majority of the inhabitant householders, or at least, by a majority of those who participated in the petition process. The crux of the dispute lies in the legal interpretation of a loophole in the Municipal Corporation Act which does not specify whether the petition should include only those who signed the petition or all inhabitants of the borough. This book considers the statutory and common law prerogative of the Crown to grant incorporation, and concludes that the determination of whether a petition adheres to the Act is a question of fact, and not one of law.
