Buch
Zustand: Gut. 394 p. From the library of Prof. Wolfgang Haase, long-time editor of ANRW and the International Journal of the Classical Tradition (IJCT). - A very good and clean copy. - From the foundation of the city, traditionally in 753 B.C., the Romans showed an extraordinary and vital interest in private law. Even when the centre of Empire moved to Constantinople, interest remained unabated until the great compilations of law under the Emperor Justinian from 529 to 534 A.D. Discussion followed of detail upon detail to produce the purity of concept and institutions that enabled Justinian s codification to be the organizing instrument of subsequent Western European jurisprudence. -- The effort required to create this law was stupendous, an effort easily overlooked or misconstrued when one examines only the finished product under Justinian, and its subsequent impact. -- The essays in this volume relate to this effort, and explore approaches some of which relate to concepts that were to disappear with time (but have not thereby lost their significance in the struggle for law), others of which were to develop a life of their own that could not have been foreseen by their protagonists. Some essays focus on centuries of development in a major area of law, others concentrate on the particular response to an immediate dilemma. -- The essays are arranged according to traditional groupings of subject matter: Persons, Property, Succession, Contract, Delict. A final section contains papers dealing with structures of forms, whether of official law making or of juristic writings. - CONTENTS: Enuptio gentis-, Two Notes on Manus; The Divorce of Carvilius Ruga; -- Captivitas and matrimonium; The Identity of Sarapio, Socrates, Longus and Nilus in the Will of C.
