Buch. Zustand: Neu. Neuware - Originalism is the practice of reviewing constitutional cases by seeking to discern the framers' and ratifiers' intent. Original Sin argues that the 'jurisprudence of original intent,' represented on the current Supreme Court by Justices Antonin Scalia and Clarence Thomas, has failed on its own term…s. Attempts to determine the framers' intent have not brought greater determinacy and legitimacy to the process of constitutional interpretation. Instead, the method has been marked by the very flaws-including self-interested reasoning and the manipulation of doctrine-that originalists argue marred the jurisprudence of the judicial 'activists' of the Warren Court. Original Sin brings a rigorous review of the performance of the 'new originalists' to the debate, applying their methodology to real cases. Marcosson focuses on the judicial decisions of Clarence Thomas, an avowed originalist who nevertheless advocates 'color blind' readings of the Constitution which are at odds with the framers' ideas concerning anti-miscegenation and other laws. After critiquing what he sees as a troubling use of originalism and explaining why it has failed to provide a consistent basis for constitutional decision-making, the author goes on to offer an alternative approach: one that lends greater legitimacy to the Court's interpretations of the Constitution.

Buch. Zustand: Neu. Neuware - The trial of Slobodan Milosevic represents a singular moment in modern history. For the first time a former head of state must answer charges before an International Tribunal for the commission of war crimes. Taking as its starting point the existing canon of international law and conventions govern…ing actions during war, Indictment at the Hague, represents the most detailed examination of the conduct of the Serbian authorities and the individual responsibility of senior members of its leadership for war crimes. Citing the precedent of the Nuremberg trials, Cigar and Williams carefully link conscious decisions and specific deeds undertaken by the Milosevic regime that violated the protections guaranteed to civilian populations in war. The volume reproduces a collection of key documents from the Hague Tribunal, U.N. Commissions, and Human Rights Organizations which appear in print together for the first time. Indictment at the Hague is essential for all those concerned with the difficult task of sustaining the Geneva and Hague Conventions, and those who wish to understand how in the era of 'never again' the crimes of war continue to challenge the instruments of international law.

Buch. Zustand: Neu. Neuware - 'Considered as a whole, this collection offers a basis for generalisations and specialised inquiry that will support both teaching and further research on the role of women in world history.'-Itinerario 'The book deserves credit for stimulating such questions, which have broad appeal among scholars…of colonialism, including those who do not work on gender. Its broad coverage and accessible language give it access to a wider audience than many academic anthologies, thereby advancing the interests of all those who value the study of colonial history.'-Journal of Colonialism and Colonial History Women and the Colonial Gaze is the first collection to present a broad chronological and geographical examination of the ways in which images and stereotypes of women have been used to define relationships between colonial powers and subject peoples. In essays ranging from ancient Rome to twentieth-century Asia and Africa, the contributions suggest that the use of gender as a tool in the imperialist context is much older and more comprehensive than previously suggested. Contributors look particularly at the ways in which colonizers constructed a national identity by creating a contrast with the colonial 'other,' in contexts ranging from Christian views of Islam women in medieval Spain to French beliefs about Native American women. They also examine the ways in which images of gender as constructed by colonial powers impacted the lives of native women from colonial-era India to Korea to Swaziland. Comparative in its approach, the volume will appeal to students and historians of women's studies, colonialism, and the development of national identity.

As we move into an era where violence is sanitized and normalized in the media, and depicted as glamorous and fun, how will we relate to the violence in our midst Why do people and their governmen…ts choose to engage in violent activity How to peaceful people who live under violent conditions such as warfare or domestic abuse make sense of it Catherine Besteman tackles these questions in this multi-disciplinary anthology that explores the topic of violence from a wide variety of perspectives.
