La cuestión central que ha de abordarse puede ser justa la pena de cadena perpetua? es clara pero la respuesta es compleja debido a la heterogeneidad de prácticas que pueden englobarse dentro del paraguas de la cadena perpetua. Van Zyl Smit y Appleton consideran que la cadena perpetua sin posibilidad de libertad condicional nunca puede ser una pena justa y sus argumentos son próximos a la jurisprudencia del Tribunal Europeo de Derechos Humanos. Sin embargo, los autores concluyen que teniendo en cuenta cómo se implementa la cadena perpetua se están infringiendo las garantías más básicas de justicia en numerosos lugares del mundo.
