Este libro explora esta tendencia a través de un sistemático análisis legal y de datos cuantitativos, convenientemente representados en el libro a través de diversos mapas, cuadros, tablas y apéndices estadísticos. La cuestión central que ha de abordarse puede ser justa la pena de cadena perpetua? es clara pero la respuesta es compleja debido a la heterogeneidad de prácticas que pueden englobarse dentro del paraguas de la cadena perpetua. Van Zyl Smit y Appleton consideran que la cadena perpetua sin posibilidad de libertad condicional nunca puede ser una pena justa y sus argumentos son próximos a la jurisprudencia del Tribunal Europeo de Derechos Humanos.
