Mit der Würde einhergehend besteht somit das Recht auf Wohnen für jeden deutschen. Schlussfolgernd wird sich für jeden in Deutschland lebenden Menschen im Laufe seines Lebens die Frage und Herausforderung stellen, wo und in welcher Form er wohnen wird. Aus der Menschenwürdegarantie in Verbindung mit dem Sozialstaatsprinzip des Grundgesetzes ergibt sich ein Regelungs- und Gestaltungsauftrag für die Politik. So ist zwingend geboten, dass der Staat die Grundvoraussetzungen für ein menschenwürdiges Dasein sichert. Das zu garantierende 'Existenzminimum' umfasst auch das Wohnen. Die Verfasser der Hausarbeit haben sich somit zum Ziel gesetzt die Frage nachzugehen, wie der Ablauf und die damit entstehenden Herausforderungen einer Immobilienübergabe, sei es an Nutzer oder Eigentümer, möglichst reibungslos zu vollstatten ist. Hierfür wurde die Hausarbeit jeweils unter demselben Schema auf Nutzer und Eigentümer unterteilt. Zunächst wird auf die förmliche und rechtliche Begriffserklärung von Nutzer und Eigentümer eingegangen. Anschließend auf die Instrumente der Vertragsbindung in Form von Miet- und Kaufvertrag. Zu Guter Letzt wird auf den tatsächlichen Ablauf eingegangen, mit den formellen und rechtlichen Hürden, die auftreten können. Zu erwähnen ist außerdem, wie in der Statistik zu erkennen ist, dass das Verhältnis von Personen, die in Deutschland zur Miete leben, im Vergleich, zu denen die in Eigentum leben, überwiegt. Ein entscheidender Grund hierfür ist die deutsche Rechtsprechung bspw. das BGB, dessen Gesetzgebung einen starken mieterfreundlichen Markt begünstigt. Jedoch ist die Lage in Deutschland nicht nur auf die Rechtslage zurückzuführen, sondern hat auch multikausale historische und rechtliche Gründe, dass der Wohnungsmarkt in Deutschland stark Mieter lastig ist. Abschließend wollen die Verfasser der Hausarbeit erwähnen, dass wir keine Empfehlung seitens der zur wählenden Wohnsituation geben.
