The Jordanian Civil Code influenced by Islamic jurisprudence and was built on the basis of damage, contrary to other laws in the world which were founded on the basis of fault. From this component, the damage is considered the criterion in calculating the value of compensation for the financial disclosure concerned. It represents a legal rule that stands by itself, but its provisions break legal principles without being considered an exception to public principle. El presente artículo se basa en la observación científica de una serie de teorías jurídicas y sus disposiciones que, en mi opinión, no son más que una estratagema creada por la regulación jurídica que viola otras disposiciones jurídicas, como las disposiciones de responsabilidad civil o la fuerza vinculante del contrato, sin estar previstas como una excepción sobre el principio.
