Wirtschaftsfà rderung durch Vergabe von Subventionen wird als notwendige staatliche Aufgabe angesehen, um eine funktionierende Wirtschaft zu gewährleisten. Es gehà rt es aber zu den Aufgaben der EU, ein System zu schaffen, das den Wettbewerb innerhalb des Binnenmarktes vor Verfälschungen schützt. Das Gemeinschaftsrecht sieht deshalb eine Kontrolle der staatlichen Beihilfen vor. Die Durchsetzung der Beihilfekontrolle scheitert in der Praxis vielfach daran, dass der die Beihilfe gewährende Mitgliedstaat der Kommission die beabsichtigte Beihilfe nicht mitteilt und diese infolgedessen die gemeinschaftsrechtlich vorgesehene Kontrolle nicht ausüben kann. Dadurch wird das durch das Durchführungsverbot angestrebte Ziel, das Funktionieren des Gemeinsamen Marktes zu gewährleisten, zunichte gemacht. Aus der Sicht eines Wettbewerbers, der selbst keine Subvention erhalten hat, stellt sich dann die Frage, ob und wie er gegen die nach Gemeinschaftsrecht unrechtmäÃige Subventionierung des Konkurrenten vorgehen kann. Bisher fehlte eine wissenschaftliche Untersuchung, die sich damit auseinandersetzt, ob und wie der Wettbewerber auch vor deutschen Gerichten Rechtsschutz erlangen kann und auf welche Weise dieser durch das Durchführungsverbot (Art. 88 Abs. 3 Satz 3 EG) beeinflusst wird. Dies ist der Gegenstand der nachfolgenden Untersuchung. Stefan Blume gibt zunächst einen Ãberblick über das System des Beihilferechts gemäà den Art. 87 bis 89 EG und damit die Grundlagen für die Untersuchung der Rechtsschutzmà glichkeiten des Wettbewerbers gegen gemeinschaftswidrige Beihilfen vor deutschen Gerichten. Sodann geht der Autor der Frage nach, ob sich ein Einzelner vor einem deutschen Gericht auf gemeinschaftsrechtliche Bestimmungen berufen kann. Es folgt ein Ãberblick über die Wirtschaftssubventionen in Deutschland. Dabei wird insbesondere auf das Recht der Subventionsvergabe eingegangen, das wesentlich von der Ausgestaltung und Abwicklung des Subventionsverhältnisses zwischen gewährender Verwaltung und begünstigtem Empfänger bestimmt wird. Weiter werden die Rechtsschutzmà glichkeiten des Wettbewerbers bei gemein-schaftswidrigen Beihilfen untersucht. Dabei wird zwischen dem Rechtsschutz vor den Verwaltungsgerichten, den ordentlichen Gerichten und dem Bundesverfassungsgericht unterschieden. Der Schwerpunkt der Untersuchung liegt auf dem verwaltungsgerichtlichen Rechtsschutz, da die Subventionsvergabe im Regelfall auf verwaltungsrechtlicher Grundlage erfolgt.…
