Résumé : Si le procès fait souvent naître auprès des différentes parties une somme considérable de mécontentements, il ne produit aucun bien. Cela ne l'empêche pas de constituer une activité économique d'ampleur nationale, qui engage des dépenses…de l'État - faibles en France mais sans cependant être négligeables. S'insérant dans un champ très partiellement concurrentiel, il produit de la richesse de par l'activité des auxiliaires de justice qu'elle engendre et s'accompagne fréquemment, in fine, de transferts de richesses parfois très importants. Ces derniers aspects suffiraient déjà à justifier une analyse économique de l'institution et de son fonctionnement ; les interrogations qui se multiplient sur l'efficacité - mot dont on use ici par pure commodité, sans méconnaître la perplexité et les réticences qu'il suscite fort logiquement - de la Justice, son coût pour ses usagers comme pour la collectivité rendent plus légitime encore un tel regard. Or si les économistes ont récemment entrepris de scruter le droit, le procès lui-même n'avait guère retenu leur attention. D'où l'organisation de ce cycle de conférences à la Cour de cassation, où plusieurs pans du procès civil (lato sensu) furent livrés au regard, par définition extérieur, d'économistes, un professeur de droit étant appelé à porter une appréciation critique sur l'analyse proposée. Premier livre à proposer ce double angle d'approche du procès civil, le présent ouvrage, dirigé par Dany Cohen, professeur des Universités à Sciences Po, rassemble l'essentiel de ces contributions ; il les livre aujourd'hui au débat, à l'intention des professionnels du droit mais aussi à tous ceux (et en particulier aux étudiants de Master) que la Justice, les évolutions et difficultés qu'elle connaît, comme le visage qu'elle pourrait avoir demain ne laissent pas indifférents.
