Hielkema: Juridisch advies van rechtsgeleerde N. van Burch inzake erfpacht van een zeker leengoed. De vraag luidt of iemand die een stuk land in een erfpacht ter leen heeft gekregen zonder dit leen te verheffen voor de heer Spangen of zijn stadhouder en vervolgens deze erfpacht verkocht hebbende, voor de leenkamer als verkoper kan verschijnen met het verzoek deze erfpacht aan de koper over te dragen. Onder verwijzing naar het erfpachtrecht komt Van Burch tot de conclusie dat door de verkoop twee verschillende rechten in een persoon zijn samengekomen, waardoor het leen niet verbeurd kan worden, ook al was dit leen niet verheven, met andere woorden: de koop is rechtsgeldig. De vraag is of een leenman zijn leengoed dusdanig mag afgraven (uitdelven) zodat er niets van overblijft. De leenman is gehouden zijn leengoed te beheren naar ouder gewoonte en zal bij volharding van het uitgraven met goed gevolg via een kennisgeving of een uitdrukkelijk verbod juridisch weerhouden kunnen worden het leengoed verder teniet te doen.
