Paperback. Zustand: New. Print on Demand. This book explores the legal, social, and moral implications of recognizing and providing inheritance rights to children born outside of marriage, an issue that has sparked debate for centuries. It delves into the historical evolution of laws governing these children, examining their status in ancient civilizations, under Roman law, and within the canon law of the Catholic Church. The author traces the influence of these laws on the development of inheritance rights for "natural" children in various European countries, highlighting similarities, differences, and the progressive changes that have occurred over time. Through its comprehensive analysis of legal texts and historical documents, this book sheds light on the ongoing tension between societal norms, individual rights, and the well-being of children born from non-marital relationships. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…

Paperback. Zustand: New. Print on Demand. This book provides an in-depth exploration of the exceptio non numeratae pecuniae, a legal instrument used in Roman law to challenge the validity of an obligation on the grounds that the money was not actually paid. The author argues that the exceptio played a crucial role in shaping the nature of Roman contract law and was not merely a procedural defense as previously believed. The author's meticulous analysis of historical sources, including the writings of Gaius, Cicero, and Justinian, traces the evolution of this legal concept from its origins in the Republican era to its eventual codification in the Corpus Juris Civilis. By examining the exceptio within the broader context of Roman law and legal thought, the author sheds new light on the complex interplay between legal theory and practical application. Furthermore, the author examines the exceptio's impact on the development of the literal contract, a unique form of obligation created through written entry in an account book. The author argues that the exceptio's availability to challenge literal contracts demonstrates the importance of consent and the limits of formalism in Roman contract law. Through its rigorous scholarship and fresh insights, this book offers a valuable contribution to our understanding of Roman law and the origins of modern contract law. It will appeal to scholars and students of Roman law, legal history, and anyone interested in the evolution of legal institutions. Paperback. Zustand: New. Print on Demand. This book examines the historical development of the concept of educational child support as a form of child support within marriage. This topic was not comprehensively addressed by legal scholars and thus created a legal lacuna. Starting with an analysis of pertinent Roman law texts, the author offers a thorough and systematic exposition of the debate on educational child support as it has evolved through the writings of jurists and legal philosophers. The author also investigates the views of more recent scholars and their contributions to the field. The book places particular emphasis on the distinction between educational child support and maintenance, arguing that the former should be considered a distinct obligation legally enforceable by the child, going beyond mere sustenance. Through the scrupulous examination of relevant case law and scholarly commentary, this book provides a nuanced understanding of the complex legal terrain surrounding educational child support in marriage. Paperback. Zustand: New. Print on Demand. This book focuses on the concept of 'persona' within Roman law, particularly the ways in which a person, whether natural or legal, was viewed within that legal system. The author explores the concept of a 'persona' in Roman law, how it was defined, distinguished and utilised in Roman jurisprudence and provides a detailed study of the concept across the development of Roman law. Ultimately, the author sheds light on how Roman jurisprudence both created the idea of a legal person, distinct from an individual, and how that concept has shaped our modern understanding of a corporation or institution as a distinct entity before the law. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format.
