Paperback. Zustand: New. Print on Demand. This book delves into the realms of Confessory and Negatory actions, two remedies available in Roman law to protect servitudes, real rights over another's property, and negative liberties. The author challenges the prevailing doctrine that Confessory actions always arise from servitudes, and Negatory actions from liberty, arguing instead that both can originate from either source, or even from a general law of liberty. The book carefully examines legal texts and provides a coherent interpretation that reconciles seemingly contradictory rulings, offering a fresh perspective on the nature and origins of these important legal remedies. Its insights shed new light on the intricate legal landscape of ancient Rome and contribute to a deeper understanding of property rights and the protection of individual freedoms in antiquity. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…
