El artículo 24.1 de la Constitución Española establece que todas las personas tienen derecho a obtener tutela efectiva de los jueces y tribunales en el ejercicio de sus derechos e intereses legítimos. Atento a que se trata de órganos judiciales, la tutela en cuestión no puede provenir sino del ejercicio de la fun…ción jurisdiccional, materializada en el dictado de una sentencia que resulte tanto eficaz como eficiente. Lo primero se logra a partir del dictado de un pronunciamiento que resulte verdaderamente ajustado a derecho; lo segundo, en cambio, de la mano de un decisorio que requiera para su emisión de la menor utilización de recursos posible, especialmente tiempo. Luego, si al proceso se lo concibe como es debido, esto es, como una empresa metódica de la que se valen los Jueces para adquirir el mejor conocimiento posible de los hechos de la causa respecto de la cual deben ejercer su función jurisdiccional, no pueden caber dudas de que el mismo se vuelve una verdadera garantía de imparcialidad y eficacia para los justiciables. De modo tal que se constituye aquél, en cuanto instrumento epistémico de los órganos judiciales del Estado, en condición necesaria -aunque no suficiente- de la tutela efectiva garantizada a nivel constitucional. Fue a raíz de comprender esto último que el autor se adentró en el estudio minucioso de un conjunto de elementos de Teoría General del Proceso, convencido de que la concepción tradicional que se tiene de los mismos, necesita de una vuelta de tuerca. El resultado de dicha investigación se encuentra volcado en la presente obra ensayística, donde se realiza un novedoso análisis de una serie de instituciones que giran en torno del proceso judicial; valiéndose al efecto no sólo de las herramientas que pertenecen a la clásica dogmática jurídica sino también de ciertos métodos que son más bien propios de otras ciencias sociales o de saberes aún más generales, como es el caso de la economía, la sociología, la filosofía o incluso la psicología.

These spaces generalize the classical Lebesgue spaces by replacing the constant exponent p with a variable exponent p(x). They were introduced in the early 1930s… but have become the focus of renewed interest since the early 1990s because of their connection with the calculus of variations and partial differential equations with nonstandard growth conditions, and for their applications to problems in physics and image processing. The book begins with the development of the basic function space properties. It avoids a more abstract, functional analysis approach, instead emphasizing an hands-on approach that makes clear the similarities and differences between the variable and classical Lebesgue spaces. The subsequent chapters are devoted to harmonic analysis on variable Lebesgue spaces. The theory of the Hardy-Littlewood maximal operator is completely developed, and the connections between variable Lebesgue spaces and the weighted norm inequalities are introduced. The other important operators in harmonic analysis - singular integrals, Riesz potentials, and approximate identities - are treated using a powerful generalization of the Rubio de Francia theory of extrapolation from the theory of weighted norm inequalities. The final chapter applies the results from previous chapters to prove basic results about variable Sobolev spaces.

These spaces generalize the classical Lebesgue spaces by replacing the constant exponent p with a variable exponent p(x). They were introduced in the ea…rly 1930s but have become the focus of renewed interest since the early 1990s because of their connection with the calculus of variations and partial differential equations with nonstandard growth conditions, and for their applications to problems in physics and image processing. The book begins with the development of the basic function space properties. It avoids a more abstract, functional analysis approach, instead emphasizing an hands-on approach that makes clear the similarities and differences between the variable and classical Lebesgue spaces. The subsequent chapters are devoted to harmonic analysis on variable Lebesgue spaces. The theory of the Hardy-Littlewood maximal operator is completely developed, and the connections between variable Lebesgue spaces and the weighted norm inequalities are introduced. The other important operators in harmonic analysis - singular integrals, Riesz potentials, and approximate identities - are treated using a powerful generalization of the Rubio de Francia theory of extrapolation from the theory of weighted norm inequalities. The final chapter applies the results from previous chapters to prove basic results about variable Sobolev spaces. 324 pp. Englisch.
