Es wird der Widerstand gegen die Unverjährbarkeit von Kriegsverbrechen und Verbrechen gegen die Menschlichkeit geschildert und die Konsensbildung nachgezeichnet, welche in der Schweiz aufgrund ihrer historischen, politischen und kulturellen Verhältnisse besonders schwierig war. Dabei zeigt sich, dass die gesetzliche Regelung eine Sache ist, die tatsächliche Verfolgung aber eine ganz andere. Als exemplarisches Beispiel wird dargelegt, dass in der Schweiz vermutlich unverjährbare Verbrechen am Volk der Jenischen begangen wurden, die bis heute ungeahndet geblieben sind.

Zu Recht oder zu Unrecht Die Autorin kommt zum Schluss, dass die beidseitige Strafbarkeit weiterhin von Bedeutung ist - und zwar nicht zwecks nationalstaatlicher Abschottung und auch nicht, weil das Strafrecht einem fixierten Kulturkreis zuzuordnen und von anderen Kulturkreisen abzugrenzen wäre, sondern vielmehr, weil es der Verwirklichung der rechtsstaatlichen Idee dient, dass jede Rechtsordnung für ihre Straftaten ein vom Gesetzgeber definiertes Kaleidoskop haben muss und auch nur dafür Rechtshilfe geben kann.
