Hierbei wird - neben der dogmatischen Ableitung des Rechts - speziell die Frage der richterlichen Würdigung des Schweigens untersucht. Die Arbeit ist dreiteilig aufgebaut: im ersten Teil wird die deutsche Rechtslage behandelt, im zweiten die englische und in einem dritten Teil werden die Ansätze beider Rechtsordnungen verglichen. Die Analyse zeigt, dass (ungeachtet der Unterschiedlichkeit der Rechtssysteme) erhebliche Strukturparallelen bestehen. In beiden Rechtsordnungen ist das Schweigerecht aus der Würde des einzelnen abzuleiten. Zudem ergibt sich, dass jede Form der Interpretation des Schweigens aus normativen Gründen (Unschuldsvermutung, Fairness) unzulässig ist.
