Paperback. Zustand: Very Good. This is a surreal time for freedom of speech. While the legal protections of the First Amendment remain strong, the culture is obsessed with punishing individuals for allegedly offensive utterances. And academia -- already an institution in which free speech is in decline -- has grown still more intolerant, with high-profile "disinvitation" efforts against well-known speakers and demands for professors to provide "trigger warnings" in class. In this Broadside, Greg Lukianoff argues that the threats to free speech go well beyond political correctness or liberal groupthink. As global populations increasingly expect not just physical comfort but also intellectual comfort, threats to freedom of speech are only going to become more intense. To fight back, we must understand this trend and see how students and average citizens alike are increasingly demanding freedom from speech.…

Hardback. Zustand: Good. Thanks to the First Amendment, Americans enjoy a rare privilege: the constitutional right to lie. And although controversial, they should continue to enjoy this right.Finalist for the Silver Gavel Award by the American Bar AssociationWhen commentators and politicians discuss misinformation, they often repeat five words: "fire in a crowded theater." Though governments can, if they choose, attempt to ban harmful lies, propaganda, misinformation, and disinformation, how effective will their efforts really be? Can they punish someone for yelling "fire" in a crowded theater?and would those lies then have any less impact? How do governments around the world respond to the spread of misinformation, and when should the US government protect the free speech of liars? In Liar in a Crowded Theater, law professor Jeff Kosseff addresses the pervasiveness of lies, the legal protections they enjoy, the harm they cause, and how to combat them. From the COVID-19 pandemic to the 2016 and 2020 presidential elections and the January 6, 2021, insurrection on the Capitol building, Kosseff argues that even though lies can inflict huge damage, US law should continue to protect them. Liar in a Crowded Theater explores both the history of protected falsehoods and where to go from here.Drawing on years of research and thousands of pages of court documents in dozens of cases?from Alexander Hamilton's enduring defense of free speech to Eminem's victory in a lawsuit claiming that he stretched the truth in a 1999 song?Kosseff illustrates not only why courts are reluctant to be the arbiters of truth but also why they're uniquely unsuited to that role. Rather than resorting to regulating speech and fining or jailing speakers, he proposes solutions that focus on minimizing the harms of misinformation. If we want to seriously address concerns about misinformation and other false speech, we must finally exit the crowded theater.…

Hardback. Zustand: Good. The Second Bill of Rights brings back from obscurity the greatest speech of the greatest president of the twentieth century, to issue a stirring call for much-needed rights that were never enacted. In 1944, Franklin Delano Roosevelt gave a State of the Union Address that was arguably the greatest political speech of the twentieth century. The speech began what Cass R. Sunstein calls the Second American Revolution by giving form and specificity, for the first time, to the concept of human economic rights. Many of the great legislative achievements of the past sixty years stem from Roosevelt's proposal for a Second Bill of Rights. Yet these rights have never been written into the Constitution, and they remain the subject of passionate debate. In recent years they have even lost ground. Using FDR's speech as a launching point, Sunstein examines the "legal realist" school of thought, which decisively refuted the idea of laissez-faire economics; describes how Roosevelt gradually developed the idea of a Second Bill of Rights; and asks why the Second Bill, which was almost enacted under the Warren Court, has never attained the constitutional status FDR sought for it. The reason, Sunstein maintains, is not anything unique to American culture or temperament but a particular historical accident: the election of Richard Nixon as President in 1968. This is an ambitious, sweeping book that argues for a new vision of FDR, of constitutional history, and of our current political scene. The Second Bill of Rights is an integral part of the American tradition and the starting point for contemporary political reform.…
